God's Class Action Law Suit

Post by yogi »

Sylvia Ann Driskell, 66, of Auburn, Nebraska, is asking a federal judge to decide whether homosexuality "is or isn't a sin." Apparently this is a legitimate suit but there is no prescient nor case law cited in her legal briefs. I'm pretty sure I know the outcome of this law suit, but it would be very interesting to see the judge's written decision.

We've heard of this over here, and it brought hoots of derision that this woman could even think of trying, as an "ambassador" for God and Jesus, to bring a law suit against the world's homosexuals.

Although we're extremely tolerant of homosexuality over here, there're still pockets of people who believe that it's sinful, whether they actually go to church or not. The AIDS crisis just added fuel to the fire.

The judge has a difficult question to answer, depending on how he/she views the matter, because either answer could spark anger in those opposed to the verdict. Surely this shouldn't be a matter for the law, but one which various churches've been debating for years? I don't think there's really a pleasing answer to it, and I'd hope that the matter'd be thrown out of court.

I don't think any churches have debated this issue. All the ones I know of thing it's outright sinful. End of story.

The article says legal brief's were filed but it didn't go so far as to say the case will actually be heard. There has been a tradition since the beginning of this country to keep the government out of religious matters. It's commonly called the separation of church and state. A federal judge would be violating that principle if he heard the case and tried to litigate what is a sin. Thus I don't see how this suit ever got to this level.

Many years ago there was a suit that went all the way up to the supreme court. It involved defining what is pornography. The decision was that it cannot be defined from a federal law point of view and that each community had to define it on their own. I'm thinking that homosexuality would fall into that same line of thought. It's sinfulness cannot be litigated under our system of laws.

The Church of England's leader says that sex outside of marriage is a sin full-stop, whether between hetero or homosexual couples. The Catholic church says that if a man abstains from gay sex for 3 years, then he can still be ordained as a priest, but others frown on the practice. The subject's been debated for years, as some vicars're openly in gay relationships, whilst priests hide in the closet. This goes against Christian teachings and practices, but some churches're more tolerant than others. In Hindu temples, homosexuality isn't considered a religious sin at all, and their tolerance of it stretches back a long way.

If God's all-forgiving, surely he wouldn't turn someone away simple because they were gay?

This woman sounds as though she has a personal intolerant attitude towards gay men or lesbian women, probably born out of how she was taught, ignorance or both.
